SAPs are allowed, if they voluntarily choose to do so, to conduct a remote “face-to-face” evaluation and assessment while this policy is in effect during the pandemic.

At the beginning of the COVID pandemic, the Department of Transportation (DOT) Office of Drug and Alcohol Policy and Compliance (ODAPC) provided guidance about the impact of the COVID-19 public health emergency on DOT drug and alcohol testing requirements for employers, employees, and service agents (collectors, MROs, SAPs). 

On April 4, 2020, ODAPC provided supplemental information specific to performing remote evaluations by Substance Abuse Professionals (SAP) and the re-qualification timelines for collectors, Medical Review Officers (MRO), Screening Test Technicians (STT) and Breath Alcohol Technicians (BAT), and SAPs.  

As of December 09, 2020, this statement is now effective through June 30, 2021.

Virtual SAP Assessments and Evaluations Allowed During Pandemic

Under federal regulations, the SAP must conduct a face-to-face, or in-person, assessment and evaluation of an employee who has violated DOT drug and alcohol regulations. 

ODAPC recognizes that conducting face-to-face assessments and evaluations during the pandemic may not be possible for certain individuals.

SAPs are allowed, if they voluntarily choose to do so, to conduct a remote “face-to-face” evaluation and assessment while this policy is in effect during the pandemic.

ODAPC recommends that, when a SAP conducts assessments and evaluations remotely, the format of the assessment be documented in the final report for reference.

ODAPC realizes that performing evaluations remotely may not provide as much information to the SAP as a face-to-face evaluation would, but believes remote evaluations are preferable to not performing the evaluations at all. 

SAPs who choose to conduct initial assessments and evaluations and follow up evaluations remotely should consider the following parameters:

  • The technology used should permit a real-time two-way audio and visual communication and interaction between you and the employee.
  • You should determine if the quality of the technology (e.g., speed of the internet connection, clarity of the display, application being used, etc.) is sufficient for you to gather all the visual (e.g., non-verbal physical cues) and audible information you would normally observe in an in-person face-to-face interaction.
  • You may only utilize the technology if your State-issued license authorizes you to do so and within the parameters of that authority.

Delayed Collector and Other Service Agents Requalification Is Allowed

Under federal regulations, collectors, MROs, STT/BATs, and SAPs are required to maintain their DOT required qualifications by completing refresher training courses to continue acting as service agents in the DOT drug and alcohol testing program. 

  • Collectors and STT/BATs must complete refresher training every five years
  • MROs must complete requalification training every five years, and
  • SAPs must complete 12 professional development hours every three years

DOT realizes that during the pandemic, these service agents may find it difficult to find the necessary resources (e.g., exam location or personnel to conduct mock collections, etc.) to meet their re-qualification requirements.

If a service agent is unable to meet their re-qualification due date while this statement of enforcement discretion is in effect, DOT will not consider it a non-compliance for purposes of starting a public interest exclusion proceeding against the service agent. 

DOT will consider these service agents qualified per Part 40 to continue providing the Part 40 required services while this policy is in effect.


DOT Training

All fleets need to conduct proper and thorough pre and post trip inspections, which consists of implementing quality:

  • driver training that is ongoing and consistent
  • driver education, and
  • driver awareness of current and changing traffic laws

All of this will help prevent being targeted by the DOT at roadside inspections and is a valuable resource to ensure a healthy fleet, and compliant safety practices.

Medical Card and CDL Extension Pushed To Feb 28

The Federal Motor Carrier Safety Administration on Dec. 15, extended a waiver through Feb. 28, giving drivers more time to renew expired CDLs, CLPs and med certs because of difficulty scheduling DOT physicals and driver’s license renewals due staffing shortages and other issues.

During the COVID-19 pandemic, the FMCSA feared drivers would have trouble renewing commercial driver’s license (CDL) and commercial learners permit (CLP) or getting DOT physicals for their medical cards.

So, earlier this year the FMCSA announced a waiver for CDL holders, CLP holders, and non-CDL drivers transporting essential supplies and equipment during the pandemic that would allow them to delay renewing medical cards and CDLs until December 31st, 2020.

This deadline has been pushed to February 28th.

If you have been driving essential supplies and equipment during the pandemic and referring to the waiver to delay renewing licenses or medical cards, renewals could be delayed.

What CDL holders need to do before Feb 28, 2020

  • If your Commercial Driver’s License (CDL) was up for renewal on or after March 1, 2020, you need to renew it by February 28.
  • If your medical examination and certification (or med card) expired on or after June 1, 2020, you have until February 28, to schedule a DOT physical and have it renewed.

What CLP holders need to do before Dec 31, 2020

  • If your Commercial Learners Permit (CLP) was up for renewal on or after March 1, 2020, you need to renew it by February 28, which requires the CLP holders to retake the general and endorsement knowledge tests.
  • If your medical examination and certification (or med card) expired on or after June 1, 2020, you have until February 28, to schedule a DOT physical and have it renewed.

What non-CDL holders need to do before Dec 31, 2020

  • If your medical examination and certification (or med card) expired on or after June 1, 2020, you have until February 28, to schedule a DOT physical and have it renewed.

The HOS portion of the waiver has been extended to Feb 28, 2021 and expanded to include vaccine distribution. Read the latest here

The FMCSA also issued an Enforcement Notice, explaining that it will not take enforcement action against drivers and motor carriers that fall under the terms of the waiver. However, we have seen some roadside enforcement still give violations out when drivers are meeting the waiver guidelines.

FMCSA Extending HOS Waiver To Include COVID-19 Vaccine Transportation

This notice continues and extends the HOS relief granted in Emergency Declaration 2020-002 through February 28, 2021 and expands the relief to include the transportation of vaccines and supplies related to the prevention of COVID-19.

FMCSA is continuing the exemption to support direct emergency assistance for some supply chains. 

By execution of this expansion and extension, motor carriers and drivers providing direct assistance in support of relief efforts related to the COVID-19 public health emergency are granted emergency relief from Parts 390 through 399 of the FMCSRs. 

The waiver shall remain in effect until the end of February 28, 2021, or until the President declares the COVID-19 national emergency is over.

Direct assistance means transportation and other relief services provided by a motor carrier or its drivers incident to the immediate restoration of essential services (such as medical care) or essential supplies related to COVID-19 during the emergency.

The waiver provides regulatory relief for commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to COVID-19, and is limited to transportation of:

  • livestock and livestock feed
  • medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19
  • vaccines, constituent products, and medical supplies and equipment including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19
  • supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectants, and
  • food, paper products and other groceries for emergency restocking of distribution centers or stores

Direct assistance does not include routine commercial deliveries, including mixed loads with a nominal quantity of qualifying emergency relief added to obtain the benefits of this emergency declaration.

Fully Encompassing FMCSA Waiver Extending Renewals and More Until 2021

After 6 months of the COVID-19 health emergency, most states that reopened their State Driver Licensing Agencies (SDLAs) have only resumed limited operations.

As a result, many commercial driver’s license (CDL) and commercial learners permit (CLP) holders may be unable to renew their CDLs and CLPs or provide medical certificates to their state driver licensing agencies.

Similarly, many physical exam sites are dealing with limited operations or backlogs, preventing drivers from scheduling appointments for their federally required medical card physicals.

For this reason, the FMCSA has announced a waiver effective until the end of the year, that includes previous waiver extensions, for CDL holders, CLP holders, and non-CDL drivers transporting essential supplies and equipment.

What this fully encompassing waiver will do until 2021

  • Extends expiring Commercial Driver’s License (CDL) waiver until December 31, 2020 due for renewal on or after March 1, 2020
  • Extends expiring Commercial Learners Permit (CLP) waiver until December 31, 2020 due for renewal on or after March 1, 2020, without requiring the CLP holders to retake the general and endorsement knowledge tests
  • Waives the requirement that CLP holders wait 14 days to take the CDL skills test until December 31, 2020
  • Waives the requirement that CDL holders, CLP holders, and non- CDL drivers have a medical examination and certification, provided they have proof of a valid medical certification and any required medical variance that were issued for a period of 90 days or longer: 
    • If medical certification was valid on February 29, 2020 and expired on or after March 1, 2020 but before June 1, 2020, the requirement is waived until October 31, 2020
    • If medical certification expired on or after June 1, 2020, the requirement is waived until December 31, 2020
  • Waives the requirement that, in order to maintain the medical certification status of “certified,” CDL or CLP holders provide the State Driver Licensing Agency (SDLA) with an original or copy of a subsequently issued medical examiner’s certificate and any required medical variance:
    • Who have proof of a valid medical certification or medical variance that expired on or after March 1, 2020 but before June 1, 2020, the requirement is waived until October 31, 2020
    • Who have proof of a valid medical certification or medical variance that expired on or after June 1, 2020, the requirement is waived until December 31, 2020
  • Waives the requirement that the SDLA change the CDL or CLP holder’s medical certification status to “not certified” upon the expiration of the medical examiner’s certificate or medical variance: 
    • Who have proof of a valid medical certification or medical variance that expired on or after March 1, 2020 but before June 1, 2020, the requirement is waived until October 31, 2020
    • Who have proof of a valid medical certification or medical variance that expired on or after June 1, 2020, the requirement is waived until December 31, 2020
  • Waives the requirements that the SDLA initiate a CDL or CLP downgrade upon the expiration of the medical examiner’s certificate or medical variance:
    • Who have proof of a valid medical certification or medical variance that expired on or after March 1, 2020 but before June 1, 2020, the requirement is waived until October 31, 2020
    • Who have proof of a valid medical certification or medical variance that expired on or after June 1, 2020, the requirement is waived until December 31, 2020
  • Until December 31, 2020, FMCSA continues to recognize the validity of CDLs issued by Canadian Provinces and Territories and Licencias Federales de Conductor issued by the United Mexican States  when such jurisdictions issue a similar notice or declaration extending the validity date of the medical examination and certification and/or validity of the corresponding commercial driver’s license due to interruption to government service resulting from COVID-19

The FMCSA also issued an Enforcement Notice, explaining that it will not take enforcement action against drivers and motor carriers that fall under the terms of the waiver. However, we have seen some roadside enforcement still give violations out when drivers are meeting the waiver guidelines.

PennDOT Extends CDL, Commercial Learner’s Permits and HME Expiration Dates

Pennsylvania Department of Transportation (PennDOT) announced Tuesday that, in response to statewide COVID-19 mitigation efforts, expiration dates for commercial driver licenses and commercial learner’s permits will be extended for Pennsylvania residents through September 30, 2020.

This PennDOT extension now lines up with the Federal extension announced in June.

Expiration extensions will apply to the following credentials:

  1. Commercial learner’s permits: if scheduled to expire from March 16, 2020  – September 30, 2020
  2. Commercial driver licenses: if scheduled to expire from March 16, 2020 – September 30, 2020
  3. Hazardous Materials Endorsements (HME): for individuals who are a Pennsylvania-licensed commercial driver’s license holder and held a valid, unexpired HME with a determination of no security threat on or after March 6, 2020

The extension for deadlines related to expiring non-commercial driver license, photo identification cards, learner’s permits and camera cards is on August 31, 2020.

Fleets Transporting In Virginia Face New Covid-19 Rules And Fines

Companies with Virginia truck drivers will have to create infectious disease preparedness and response plans

Virginia is the first state to impose enforceable COVID-19 safety requirements in the workplace. Fleets based in or operating in the state are now figuring out what the effect of this new law will be for their drivers and operations.

The final Emergency Temporary Standard rule was first made public on July 17 by the Virginia Department of Labor and Industry and anticipates publication during the week of July 27.

What is required once the rule is published?

According to the rule, all companies based in Virginia will be required to:

  • classify employees by risk level (very high, high, medium and lower) based on workplace hazards and job tasks
  • establish policies for employees to self-monitor for COVID-19 signs and to report symptoms
  • put in place procedures to prevent employees who are known to have or are suspected of having COVID-19 from infecting co-workers, and
  • develop and implement a written infectious disease preparedness and response plan for employers of people in “medium risk” jobs (including truck drivers) that require being closer than 6 feet to other employees or the general public

Employers have 60 days from the rule’s effective (publication) date to develop the plan.

What does the Virginia Trucking Association (VTA) say?

According to Freightwaves, Dale Bennett, president and CEO of the Virginia Trucking Association, is seeking more clarity from the state on what he says could be a major regulatory burden for his members as well as shippers and receivers.

“If you have motor carriers or trucking companies that either do business in Virginia or have facilities in Virginia and you haven’t paid attention to this, you need to wake up,” Bennett told FreightWaves. “Anytime you talk about a new regulation, there’s going to be some cost associated with that. There are now certain requirements and responsibilities on the employer to report when employees test positive. These aren’t just guidelines anymore.”

For carriers that do not have locations in Virginia, once a driver steps out of the cab inside Virginia, there may be parts of these regulations that affect them.

What are the penalties if you disregard the rules?

According to Virginia Department of Labor and Industry, they can enforce the rules with fines for noncompliance ranging from $13,000 to $130,000 for repeat offenders and the state may shutter an employer’s operations, if deemed necessary.

How long will this last and what about other states?

The rules are set to expire six months after becoming published but could be extended if the state decides to do so.

PennDOT Extends Physical Exam Waiver for Bus Drivers

School bus drivers who need a new physical have until July 31, 2020 to complete one

In response to the request submitted by the Pennsylvania School Bus Association, Pennsylvania Department of Transportation granted the extension to waive the annual physical exam requirement for school bus drivers under 67 Pa. Code §71.3.

The waiver applies to any school bus driver with proof of a valid physical exam that expired on or after March 13, 2020.

School bus drivers who need a new physical exam have until July 31, 2020 to complete one.

According to PennDOT, this waiver does not apply to:

  • drivers who cannot provide proof of physical exam expiring after March 13, 2020;
  • new drivers who have never competed a physical exam;
  • drivers who have been diagnosed with a medical condition that would disqualify the driver from operating a school bus, since their last physical exam;
  • drivers who have developed a condition that requires a medical waiver, since their last physical exam; and
  • drivers required to undergo additional 3-month examinations under 67 Pa. Code §71.3(b)(4)(B)(I) unless the driver has completed the required 3-month exam.

A school bus driver should be able to satisfactorily perform the following activities demonstrating the school bus driver meets the intent of this section:

  • Walk around a school bus
    • Pennsylvania school buses have a maximum length of 45 feet and width of 102 inches. Drivers should be able to satisfactory walk at least 107 feet without problem.
  • Bend to check underneath the bus unassisted by any medical apparatus
    • The bottom of a school bus chassis is typically three (3) feet off the ground.
  • Climb and descend the school bus steps—normally 3 steps—which are each 12-16 inches high.
  • While using the right foot only, alternate between the service brake and accelerator
    • Necessary strength and flexibility to operate all controls with hands and feet.
  • Hold the service brake—the main brake on the bus—with the right foot with 40-60 lbs. of force for 60 seconds.
  • Move quickly and easily from the driver’s seat, through the aisle, and exit the rear emergency exit of the school bus.
    • School bus aisles have a minimum clearance of 11 and 3/4 inches wide, with a typical clearance of 15 inches.

School bus drivers are responsible for the safe transportation of our most precious cargo, our children. It is imperative that every school bus driver is physically capable of not only safely operating the school bus, but also performing critical safety functions in the event of an emergency while operating that school bus.

CDL and Medical Card Waiver Extended Until Sept 30, Due To COVID-19

The Federal Motor Carrier Safety Administration (FMCSA) has extended a temporary waiver that deals with expired commercial drivers licenses (CDLs) and medical cards after March 1st, 2020, due to the COVID-19 health emergency.

The extended waiver now gives drivers until September 30, 2020 to renew their commercial driver’s licenses, commercial learner’s permits and medical cards. This extension only applies to drivers whose CDL, CLP or medical card expired on or after March 1.

Additionally, drivers with an expired medical card are required to carry a paper copy of the expired medical card until it is renewed and drivers with DOT medical cards, issued for at least 90 days, that expire after March 1, 2020 may continue to operate without a new DOT physical exam.

The original temporary FMCSA waiver was set to expire June 30. However, the government recognized that state licensing facilities and medical offices performing DOT physicals may be closed or have restricted hours or staffing.

The FMCSA also issued an Enforcement Notice, explaining that it will “exercise its enforcement discretion to not take enforcement action” against drivers and motor carriers that fall under the terms of the waiver. FMCSA extends waiver for pre-employment testing

COVID-19 Pre-Employment Testing

As more businesses are opening back up from the COVID-19 health emergency, the FMCSA earlier this month extended a waiver for pre-employment testing that would reduce drug-testing costs as they rehire drivers.

Current regulations require that new-hire drivers must pass a pre-employment drug and alcohol test for controlled substances before they can perform safety-sensitive functions. These pre-employment drug tests are waived if the new-hire driver was part of a drug testing program within the previous 30 days and was either tested for controlled substances within the past six months or participated in the random controlled substances testing program for the previous 12 months.

This waiver has been extended from 30 days to 90 days and only valid when hiring drivers on or before September 30, 2020. This is basically extending the length of time a driver can be out of a random testing pool from 30 days to 90 days and be exempt from pre-employment testing if all criteria are met as stated in 382.301(b).

This is in response to the COVID-19 public health emergency where many employers have laid off, furloughed, or temporarily removed employees from safety-sensitive functions and removed from the random pool for controlled substances and alcohol testing for a period greater than 30 days.

According to the FMCSA, “As employers begin to recall drivers who were furloughed, laid off, or otherwise not working for the company for more than 30 days, the cost and logistical barriers of testing a large influx of drivers in a short timeframe are significant, at a time when the commercial trucking and motor coach industry is facing unprecedented economic challenges. This problem is further compounded by the reduced availability of controlled substance testing resources due to continued facility closures or other testing impediments caused by the COVID-19 public health emergency.”

Employers must verify that the driver participated in the controlled substances testing specified and had no recorded violations of another DOT agency’s controlled substances use regulations within the previous 6 months. This requires a CDL Drug and Alcohol Clearinghouse detailed query.
